CONFIRMATION OF RIGHTS TO UPLOADED CONTENT

Uploading any video template to the cmex.ai Creator Dashboard constitutes Your unconditional acceptance of all terms below. If You disagree with any single provision — do not upload the content.
1. Your warranties upon upload
Each time You upload a video as a template, You represent and warrant that:
1.1. You are the sole author of the video or hold a valid license / written permission from the rights holder to use, modify, and publish this video on cmex.ai as a template for face-swap purposes.
1.2. You have obtained informed written consent from each individual depicted in the footage for:
- the use of their likeness on the cmex.ai platform;
- the processing of their likeness, including face-swap technology;
- the creation of derivative video materials based on their likeness by third-party users of the platform.
1.3. The uploaded material does not contain:
- scenes involving minors in any unlawful context;
- material of a sexual, pornographic, or erotic nature;
- scenes of violence, cruelty, torture, or degradation of human dignity;
- extremist material, content inciting hatred or discrimination;
- copyrighted excerpts from films, TV series, broadcasts, music videos, or sports events without explicit licensing;
- imagery of well-known public figures (politicians, actors, musicians, athletes, bloggers) without their written consent;
- trademarks, logos, or other protected intellectual property of third parties.
1.4. Use of Your content on the platform does not infringe upon:
- copyrights and neighboring rights of third parties;
- personal non-property rights of individuals depicted in the footage;
- legislation on personal data protection and privacy;
- legislation on trademarks, patents, and other intellectual property;
- the laws of Your country of residence, the country of the platform's incorporation (United States of America, State of Delaware), or the country where the servers are located (French Republic).
2. What happens upon receipt of a complaint
2.1. Upon receipt of a substantiated complaint from a rights holder, a depicted individual, their legal representative, or a government authority, we:
- immediately remove Your template and all derivative videos from public access without prior notice;
- conduct an internal review of the circumstances;
- request from You documentary evidence of Your right to use the content within 5 (five) business days.
2.2. If within the specified period You:
- fail to provide the requested documents, or
- the documents provided are deemed by us to be insufficient or unreliable, or
- fail to respond
— we reserve the right to permanently delete the template and all its derivatives without the possibility of restoration, block Your Creator account, and transfer the available data (including IP address, user-agent, date of consent, contact information) to lawful rights holders and competent authorities upon their substantiated request.
2.3. Decisions regarding content removal and account blocking following the review are not subject to appeal through customer support. They may only be contested through the judicial bodies of the United States of America in accordance with Section 6 of this agreement.
3. Financial liability
3.1. All revenue (credits, bonuses) received by You from the use of content that infringes third-party rights shall be considered unjustly obtained and subject to full return.
3.2. In the event of any lawsuit, claim, or fine asserted against the cmex.ai platform (FunnyMoney Media Inc., State of Delaware, USA) by third parties or government authorities in connection with content uploaded by You, You shall:
- fully indemnify and hold harmless the platform, its founders, employees, and affiliated persons from any liability;
- reimburse the platform for all incurred losses, including court costs, attorney fees, court-ordered payments, and regulatory fines;
- independently bear all expenses related to defending the platform's interests in pre-trial and judicial proceedings.
4. Storage of consent data
At the moment of Your consent we record and store indefinitely (for purposes of potential judicial proceedings):
- Your user identifier on the platform;
- the exact date and time of consent (UTC);
- the IP address of the device from which consent was given;
- technical data of the browser (User-Agent);
- the version of this agreement under which consent was given.
This data may be transferred to rights holders, their legal representatives, government authorities, and courts in accordance with applicable law.
5. Changes to terms
5.1. We reserve the right to unilaterally modify these terms. When the version of the consent is updated (for example, from v1 to v2), You will be required to confirm the new terms upon Your next attempt to upload a template.
5.2. Content previously uploaded by You remains subject to the version of the terms in effect at the time of its upload. This does not release You from liability under Sections 1.3 and 1.4 of this agreement, which have permanent force.
6. Jurisdiction and governing law
6.1. This agreement is governed by the laws of the State of Delaware (USA).
6.2. All disputes shall be resolved in the competent courts of the State of Delaware.
6.3. If You disagree with the jurisdiction or governing law — immediately cease using the template upload function and remove Your previously uploaded content through customer support.
